I just recently used my HL 850 for the first time and started gouging the board by about 3mm.  The depth setting is on the P or Park so should be the shallowest setting but I notice that the forward adjustable shoe is fully 3mm lower than the rear following shoe.  I can adjust this deeper but cannot get it any shallower.  This came from the factory this way and wondering if there is some internal adjustment to allow the forward plate to come into the same plane as the rear shoe.  I would appreciate it if anyone has experienced this and if there may be a fix for it short of sending it back to the factory.

With the indicator on 0, the front and rear part of the sole should be in the same plane. This is adjustable with an allen bolt underneath the moveable part of the sole (use the allen key that's attached to the cable)

In P (or park) the front shoe should be slightly lower than the back, so you can put the machine onto a flat surface without damaging the blade or the surface, as the blade couldn't touch the surface. On 0 setting the front and back sole should be level with the blade.
Keep in mind that this is only true for the normal head, but not for the rustical ones.

As you describe it the machine was assembled wrong. In case the machine is new a short trip to your dealer should yield a new one as instant replacement, in case you're over the 30 days send it in for service.
 
In your situation I would suggest calling Festool USA and talking to them.  The number is conveniently on your tool.
