battery warranty

I need to send my c15 for a warranty repair
I also noticed that my batteries are not lasting very long anymore
I've had the drill since 03/2012
Does the warranty covers issues like that?
Or is that considered wear and tear?
 
The warranty is if the batteries are dead, will not charge. That's for three years from the date of purchase.

Fortunately, you still have some time left on the warranty should the batteries become unable to charge.

I'm having problems with the gear switch
When in first gear it strips and chuck is not spinning
I was going to send the batteries too just to see if they were defected
 
It certainly won't hurt to send the batteries. The guys in service that the gadgets to test the batteries for you.

Regarding the gear issue, you may want to call and speak to the service team. Seems I remember something about that and it may be a simple fix.

I think my brain is reaching Festool info capacity.

I'm not sure if this will help but, try changing the gears with the drill the running.  I know that sounds counter-intuitive but it will realign the gears if that are out of alignment.

I have tried that but no luck
If I keep pressur with a finger on the switch it will spin a little but once I start driving it just grinds and stops spinning
