Cordless drill order

I purchased a cordless drill from an online authorized dealer. The tool arrived yesterday. The outside of the systainer was pretty dusty/dirty. I assumed it was from sitting in a warehouse. I opened up the systainer and found one of the chucks mounted on the drill, the BH60 inserted in that chuck and the Philips bit in the holder looks to have driven a couple of screws. In addition, there is no warranty registration card in the systainer.

I think I have received a drill that was returned. In the unlikely event that I keep this tool what will happen if I try to register it for warranty and it's been previously registered by somebody else? What are dealers supposed to do with tools returned?  Are the dealers allowed to sell them again as new?

 
Send it back it's probably an ex display item .
Check the serial numbers with Festool to see if it's been registered.

Your best bet is to contact the dealer. You're still within your 30-day return window, so you should be able to swap it for a new one -- regardless of whether yours was already returned once or not. (As [member=14165]Davej[/member] said, it could have been a display model. Who knows.)

As for the registration, I wouldn't worry about it. If you want to keep the one that you have now, I can double check to make sure that it hasn't been registered already.

When customers return tools, dealers can choose to resell that item if they believe that it's still in new/unused condition. Otherwise, the dealer can swap it out with us for a new one. Because there are a wide variety of returned tools ("bought it yesterday, returned it without even opening it" vs. "used it pretty hard for 29 days before returning it"), it doesn't make sense for dealers to swap every tool.

Keep me in the loop on this if you need anything else.
 
Festool dealers can sell used tools as new. Wow. I think that is illegal in some parts of the US.

This really makes the Festool brand shine even brighter.

This is a common complaint about some large camera dealers. I did not know it applied to Festool as well. I am glad I can buy a new Festool at my local Woodcraft and carefully examine it to make sure it is truly in "as new" condition and do not have to hassle with returning a used tool that was sold as new.

Let's be careful not to conflate "returned" with "used" -- or that all returned items are the same. Putting certain returned items back on the shelves is pretty common.
 
I carefully mark troublesome/defective goods that I return to the big box stores and I've actually seen the marked item put back on the shelves later on.

While it may not be a policy to resell damaged, defective or used items, it is easily circumvented by unknowing stockers or local mismanagement.

There are also consumer types that purchase for one time use that carefully repackage items to return for full refund that can also dupe the vendors with the 'unused' wrong item excuses.

Legally in some states and municipalities, once an item has been sold, and leaves the retail location, the item is considered used, whether the packsge has been openned or not, since the retailer has no knowledge of what happenned to the item once it left the retaillers location.

I know it's common for some retaillers, especially of high end items, to have "new" items that are used as didplays, or openned so a customer can look at thr item. It's not also uncommon to examine an item that "wasn't used" and then reshelf the item as new, but it's not legal everywhere to do so.
