Kapex 120 REB Miter Lock Not Holding

I just got a new Kapex 120 REB and I noticed that when I set it at a non-standard angle (10 degrees) and push the black handle down, I can still push it side to side (left to right). I am pretty sure this isn't normal, but as this is my first experience with the Kapex, I'm not sure if that is normal. I recently saw someone else post about the same issue on Facebook, so maybe I'm not the only one with this issue.

I'm hoping someone has some good advice on this. I hate to have to send it back for repair when it's only a few days old.
 
My Kapex does the same , but it does take a LOT of sideways effort to get it to move once the black lever has been locked down.
I can't foresee it moving during any cutting procedure and I can honestly say, I've never had any issues with movement in the 7 years I've been using mine...!

Only at the positive lock positions is the Kapex mechanically fixed to a miter angle setting, between those positions it is held in place by friction in the miter lock mechanism.  In a properly setup Kapex the setting can be disturbed between the locking positions but it takes a deliberate and sharp hit to the side of the miter handle, I have never had the setting drift due to the normal forces exerted during cutting.
