You might try asking them what tool number they are selling.  If it starts with 100...then I believe it’s the new motor EB (“old”) model.  If the tool number starts with 495...then I believe it’s the old motor EB (“old”) model.  Both are the “old” EB (vs new REB) kapex.

I purchased the kapex on sale at Hartville, spoke to the festool reps there and they told me it has the new motor and that the kapex has had the new motor for years now.  But its still an issue because it was a big problem that it carries a stigma with it now.  So from festool, the old model kapex comes with the new updated motor and has been for a few years now.

I'm sorry , but this is just inexcusable. 

1. Do they not know what they are selling ?
2. Are they delibertly selling a product they know is prone to trouble without repairing it with their supposed fix ?
3. Even worse is they're only offering a one year warranty on this turkey.

Shame on Festool for this.  They need to be doing a better job given the Kapex history.

Hopefully the marketplace will show them their error.  But, I doubt it.

And they are offering a one year warranty because its supposedly used.  I got a 3 year warranty on my brand new old model kapex that i purchased last week for $999  I don’t know how people can complain about a 1 year warranty on used goods.  How many other companies offer this kind of warranty on used equipment? Maybe 30-90 days at best.  If you want a 3 year warranty, buy the kapex new from a retailer that has it on sale. 
 
Think you've missed my point.

I'm saying festool is being disingenuous by not stating openly what motor is in the kapex they are offering re-cond . Additionally, they are adding to the insult by not fixing the problem before they re-sell the defective tool before it goes back out. 

And, piling on top of both those, they are putting pretty much all the risk to the naive customer.  Shame, shame.  All of this for something they know is an issue.

I'm fine with a reduced warranty for a used or repaired tool - as long as it's been repaired properly.  When you KNOWINGLY look the other way on substandard work - there's a problem .

Even low skilled employees parrot what their handlers tell them to.  This looks like a conscience decision to cast shade from the same people that designed a poor motor, then tried to deny there was an issue, then blamed the users.    We're all adults , and most people realize there's always a bit of caveat emptor in place; but people should be given all the facts openly in my view.
