I have a brand new Ti 15 Hybrid Impact Cordless Drill / Driver - 564291 which I just tried to use today.  Both of my batteries are fully charged.

I was simply attempting to drive in some self tapping screws into some 3/4 plywood.  The drill does not respond most of the time with the first or second or third pull of the trigger.  It just gives off an audible sound which I thought, according to the manual, was an indication of overheated, or overloading or something.  But it does this and I have not even started driving in the screws.  I keep pressing the trigger and keep getting the beeping from the drill.  Sometimes it works right off for one or two screws in a row, then the next three or four pulls of the trigger I get nothing but the beeping.

Is this drill malfunctioning out of the box?

Perhaps you should call Festool tomorrow ( their number is on the label on the drill) and talk to the service department.  They can walk you thru everything to decide the next step (if any).

Maybe someone else will have another explanation, but it sounds like the problem I had with my refurbished T15.  I called Festool and ended up sending the drill in for service; they replaced some of the electronics, and the drill now seems to function just fine.  In your situation, of course, you could return the drill and get a new one.  Still, it's disconcerting to get a lime-green lemon.  It's not the sort of thing one expects from Festool, but I suppose even the best have their bad days.

Is it possible you bumped the forward/reverse button and it's in the middle (sort of)?

Well, no, I checked that.  When the drill does finally operate, it is rotating in the direction expected.  The forward/reverse switch is not improperly seated.  I have a feeling I am just the recipient of a defective drill.  It can happen with any machine or company.  But I will find out for sure when I call Festool tomorrow.

Love the tools though.  They are excellent.

I contacted Festool and described  the drill's erratic performance.  The technician at Festool indicated that it did indeed sound like a malfunctioning drill and suggested I take it back to the Merchant for exchange or to be sent in for service.

I took the drill back to WoodCraft in Columbus OH and they were very helpful and quickly got me a replacement drill.  Problems gone now.
