Used CXS warranty question - purchased on eBay

I just purchased a used CXS on ebay.  Of course I have nothing to go by except the photos and the tool I received.  Gear setting 1 operates as expected but gear setting 2 screams (as in the tool literally sounds like it is screaming,) and will not even drill a 1/8th inch hole.  Now knowing my other Festools I know that this can't be right.  My question is since I can't get the info from the previous owner, how do I tell if this is still under warranty and  how do I proceed on getting this corrected. 
Everything is in great shape except the drill which shows signs of normal use, but I am afraid I have been ripped off.  Hopefully I can get this fixed under warranty or at least at a cost that does not offset the price of new.

Call Festool in the morning.  The phone number is on your CXS.  Your drill should be under warranty - but it may be beyond the first year and you will have to pay for shipping as per the Festool guarantee.  The guys in Lebanon will take care of you.

Like Peter said, your CXS is definitely still under warranty since it was introduced in June 2011, which is less than 3 years ago. If you want to shoot me an email with the serial number, I can give you information about its age more precisely.

One thing to double check is to ensure that you are fully into the 2nd speed position. If the ring gear is not fully engaged, its teeth will grind against the teeth of the first stage planetary outer gear.

Contrary to intuition, when you switch the transmission into the higher gear, you are not adding more gears. It is actually disabling the second planetary gearset from the transmission. This ring gear I mentioned above isn't shown in the graphic below, but it connects the outside of the purple second-stage planetary gears with the outside of the light-blue first-stage carrier gear. The result is that is disables the middle set of gears.

OH Cool!!!!! As I was looking for the exploded-view graphic I was expecting to post, I just realized that I already had a graphic that shows this ring gear I wanted to show. It is shown as a cutaway, and connects the 6 purple gears to the larger light-blue gear. The image below shows what 1st gear should be like (including if you are not fully engaged in 2nd gear). In 2nd gear, the yellow ring gear slides toward the right, and should be fully engaged over the top of the light-blue gear.
